1. ABOUT THESE TERMS

Welcome to The Woman.

The Woman is a wearable art and creative objects brand operated by Cloud Inspires, a business established in the Netherlands.

Throughout these Terms, “The Woman”, “we”, “us” and “our” refer to Cloud Inspires, trading through The Woman.

These Terms of Service apply to your use of our online store and to purchases made through it. By placing an order with us, you agree to these Terms together with the policies referred to in them, including our Privacy Policy and Refund/Return Policy.

Nothing in these Terms limits or excludes any mandatory rights you have under applicable Dutch or European Union consumer law.

3. OUR PRODUCTS

The Woman creates and sells handmade wearable art and creative objects.

Many pieces are individually handmade and may be one-of-a-kind. Because of the handmade nature of our work, minor variations in shape, texture, colour, surface, finishing or other characteristics may occur. Such characteristics are part of the handmade nature of the product and do not in themselves constitute a defect, provided that the product corresponds to its description and the characteristics reasonably expected from it.

We make reasonable efforts to display our products and their colours accurately. However, colours may appear slightly different depending on your screen or device settings.

The main characteristics, materials and relevant product information will be provided on the applicable product page where appropriate.

Product availability may be limited, particularly for one-of-a-kind pieces.


4. ORDERS AND CONTRACT FORMATION

By placing an order, you make an offer to purchase the selected product(s).

After your order is submitted, you will receive an electronic order confirmation. A binding purchase agreement is formed when we accept your order in accordance with the checkout and order-confirmation process.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, for example where:

  • a product is no longer available;
  • an obvious pricing or product-information error has occurred;
  • payment cannot be authorised; or
  • we reasonably suspect fraud or misuse of the store.

If payment has already been received for an order that we cannot fulfil, the relevant amount will be refunded.


5. PRICES AND PAYMENT

Prices shown to consumers are displayed in euros (€) and include applicable VAT where required by law, unless clearly stated otherwise.

Any delivery costs or other applicable charges will be clearly communicated before the customer places the order.

The total amount payable will be shown during checkout before the order is confirmed.

Available payment methods are displayed at checkout and may change from time to time.

Payments may be processed by Shopify Payments or other payment-service providers available through our store.


6. SHIPPING AND DELIVERY

We will deliver orders to the delivery address provided by the customer during checkout.

Available delivery destinations, shipping methods, applicable costs and estimated delivery times will be communicated during checkout and/or in our Shipping Policy.

Delivery times are estimates unless a specific binding delivery period has expressly been agreed.

For consumer purchases, the risk of loss or damage remains with us until the goods have been physically received by you or by a third party designated by you, other than the carrier, except where you independently commission a carrier not offered by us.

If your order appears to be lost or damaged during transportation, please contact us so that we can investigate the matter and provide the appropriate remedy.

Nothing in this section limits your statutory delivery rights.


7. RIGHT OF WITHDRAWAL — 14-DAY COOLING-OFF PERIOD

If you are a consumer purchasing online, you generally have the legal right to withdraw from your purchase without giving a reason within 14 days after the day on which you, or a third party designated by you other than the carrier, receives the goods.

To exercise your right of withdrawal, you must inform us clearly of your decision within the applicable withdrawal period.

You may do this through the withdrawal functionality made available through our online store, where available, or by contacting us at:

You may also use the statutory model withdrawal form where applicable, although use of that form is not mandatory.

After notifying us of your withdrawal, you must return the goods within the period required by applicable law.

Unless we expressly agree otherwise, the direct cost of returning goods following a change-of-mind withdrawal is borne by the customer.

We will make any refund required by law within the applicable statutory period. We may withhold reimbursement until we have received the returned goods or you have supplied evidence of having sent them back, whichever occurs first, where permitted by law.

8. CONDITION OF RETURNED PRODUCTS

During the withdrawal period, you may inspect and handle a product only to the extent necessary to establish its nature, characteristics and functioning, comparable to what would reasonably be possible in a physical shop.

You may be responsible for any diminished value resulting from handling beyond what is necessary for this purpose, to the extent permitted by applicable law.

Please return products with reasonable care and, where reasonably possible, with their original packaging and accessories.

The absence of original packaging does not by itself remove statutory consumer rights.


9. PERSONALISED AND CUSTOM-MADE PRODUCTS

The legal right of withdrawal may not apply to products that are made according to a customer's individual specifications or are clearly personalised, where the statutory exception applies.

This exception will only be relied upon where the product genuinely qualifies as customised or personalised under applicable consumer law.

The fact that a product is handmade, limited edition or one-of-a-kind does not by itself remove the consumer's statutory right of withdrawal.

Where a product is genuinely personalised or made specifically according to your individual specifications, this will be clearly indicated before purchase where applicable.

This exception does not affect your statutory rights if a personalised product is defective, damaged or does not conform to what was agreed.


10. FAULTY, DAMAGED OR NON-CONFORMING PRODUCTS

Products sold through The Woman are subject to the statutory legal guarantee and conformity requirements applicable under Dutch and European Union consumer law.

This means that a product must conform to the agreement and have the qualities and characteristics that you may reasonably expect based on the product description and other information provided before purchase.

If a product is defective, damaged on arrival, incorrect or otherwise does not conform to the agreement, please contact us as soon as reasonably possible at meetyourcreativity@gmail.com, preferably including your order number and, where helpful, photographs of the issue.

Depending on the circumstances and applicable law, you may be entitled to repair, replacement, an appropriate price reduction or termination of the agreement and reimbursement.

Nothing in these Terms limits your statutory guarantee or conformity rights.


11. HANDMADE CHARACTERISTICS AND MATERIALS

Our products may incorporate reimagined, reclaimed, repurposed, overlooked or otherwise creatively transformed materials.

Where relevant, material information and characteristics will be described on the individual product page.

Because our pieces are handmade, reasonable variations between pieces may occur.

However, the handmade, reclaimed or one-of-a-kind nature of a product does not exclude your statutory rights where the product is defective or does not conform to its description.

Customers should follow any care or usage instructions supplied with the product.


12. PRODUCT SAFETY AND USE

Products should be used only for their reasonably intended purpose and in accordance with any care, safety or usage instructions provided with them.

Where relevant, specific warnings or safety information will be provided on the product page, packaging or accompanying information.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable product-safety or consumer-protection law.


13. INTELLECTUAL PROPERTY

Unless otherwise indicated, the creative works, product designs, photographs, illustrations, graphics, written content, branding and other original material presented through The Woman are owned by or licensed to Cloud Inspires / The Woman and are protected by applicable intellectual-property laws.

You may access the store and its content for personal, non-commercial use.

You may not reproduce, commercially exploit, distribute, copy or create unauthorised derivative works from our protected content or designs without prior permission, except where permitted by law.

Third-party trademarks and content remain the property of their respective owners.


14. ACCEPTABLE USE

You may not use our website or services:

  • for unlawful or fraudulent purposes;
  • to infringe our rights or the rights of another person;
  • to distribute malicious software or interfere with the operation or security of the website;
  • to collect personal information unlawfully;
  • to impersonate another person or provide deliberately misleading information; or
  • otherwise in a manner contrary to applicable law.

We may take reasonable measures to protect the store, customers and our systems against misuse.


15. THIRD-PARTY SERVICES AND SHOPIFY

Our online store is hosted and technologically supported by Shopify.

Certain functions of the store, including payment processing, delivery integrations or other services, may be provided by third-party service providers.

Where third parties process personal information, further information is provided in our Privacy Policy.

Your purchase contract for products sold by The Woman is between you and Cloud Inspires / The Woman, not Shopify, unless expressly stated otherwise.


16. PRIVACY

We process personal information in accordance with applicable privacy and data-protection law, including the General Data Protection Regulation (GDPR), where applicable.

Information about what personal data we collect, why we process it, how long it may be retained, the parties with whom it may be shared and your privacy rights is provided in our Privacy Policy.

Shopify and other service providers may process certain personal information in connection with providing the technical infrastructure and services necessary to operate the store.

17. LIABILITY

Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.

In particular, nothing in these Terms affects mandatory consumer rights relating to defective or non-conforming products, product safety, intentional misconduct or other liability that cannot legally be excluded.

To the extent permitted by applicable law, we are not responsible for losses caused solely by circumstances outside our reasonable control where we have complied with our legal obligations.

Please include sufficient information for us to identify the order and understand the issue.

We will endeavour to acknowledge and handle complaints within a reasonable period and in accordance with applicable Dutch consumer law.

Your statutory rights and any rights you may have to seek assistance from competent consumer or dispute-resolution bodies remain unaffected.


19. CHANGES TO THESE TERMS

We may update these Terms from time to time, for example to reflect changes in our business, services or applicable law.

The Terms applicable to your purchase will generally be those made available to you when your order was placed, unless mandatory law requires otherwise.

Material changes will not retrospectively remove statutory rights attached to purchases already made.

The current version of these Terms will be available through our online store.


20. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid provision will be interpreted or limited only to the extent necessary to comply with applicable law.


21. GOVERNING LAW AND CONSUMER RIGHTS

These Terms and contracts concluded through The Woman are governed by the laws of the Netherlands, subject to any mandatory consumer-protection rules that apply to you.

If you are a consumer residing in another EU or EEA country, this choice of Dutch law does not deprive you of mandatory consumer protections that apply to you under applicable law.

Nothing in these Terms restricts any right you may have under mandatory law to bring a claim before a competent court.
